Florida Has 3rd-Highest Rate of Medical Malpractice, According to New Study

A new study reveals the worst-rated medical practices in America, based on patient reports.

The analysis conducted by personal injury lawyers Triumph Law, P.C. calculated the annual average for each state over a four-year period (2020–2023) at Medical Malpractice Payment Reports (MMPR) from the Health Resources and Services Administration (HRSA) which is an agency of the U.S. Department of Health and Human Services.

At the top of the list of the worst medical practices in the country was New Mexico. That state recorded the highest incidence rate of medical malpractice, with 22.54 medical malpractice reports per 1,000 medical practitioners. This rate is a staggering 132% higher than the national average, highlighting a significant issue with the state’s healthcare system.

New York came in number two.

Florida has the third highest rate of medical malpractice incidents relative to its registered practitioners, with 18.71 incidents of medical malpractice recorded for every 1,000 practitioners (92.68% above the national average)

The state with the best medical practices in America was North Dakota. It reported the lowest rate of medical malpractice payment reports at 2.65 per 1,000 practitioners

Commenting on the results, Robert Carichoff, personal injury lawyer for Triumph Law, P.C., said: ”Patients should feel confident in their medical providers, trusting that they will receive quality care. However, it is also important for patients to advocate for themselves if they feel the care falls below an acceptable standard.” Reporting any instances of suspected malpractice to the appropriate authorities is crucial for ensuring accountability and helping to improve overall patient safety.”     

 To ensure fair comparisons across states with different practitioner populations, the averages were adjusted to reflect the number of reports per 1,000 practitioners.
