JACKSONVILLE, Fla. — A federal grand jury has indicted a Guatemalan national on multiple charges related to immigration fraud and illegal reentry into the United States, according to the U.S. Attorney’s Office for the Middle District of Florida.
Diego Andres Garcia, 45, faces charges of possessing false documents, falsely representing a Social Security number, and illegally reentering the United States after deportation. If convicted, Garcia could face up to 10 years in federal prison for the document fraud charge, up to five years for the Social Security violation, and up to two years for the illegal reentry offense.
Court records indicate that in July 2024, Homeland Security Investigations (HSI) conducted a workplace immigration compliance inspection at a construction company in Jacksonville. Investigators allege that Garcia submitted a counterfeit Permanent Resident card and Social Security card and misrepresented his immigration status to gain employment.
Garcia was arrested on July 17, 2025. During processing, officials reportedly discovered he had previously been deported from the United States in both 2006 and 2013 and had reentered without obtaining authorization from the Attorney General or the Secretary of Homeland Security.
The case is being investigated by Homeland Security Investigations and is being prosecuted by Assistant U.S. Attorney Kevin C. Frein.
Garcia’s charges are part of Operation Take Back America, a Department of Justice initiative targeting immigration violations and transnational criminal activity.
An indictment is a formal accusation, and Garcia is presumed innocent unless proven guilty in a court of law.
