The Cost of Police Misconduct By State: Florida ranks #21

Which states are paying the most in settlements for police misconduct?

Data from the National Police Funding Database broke it down by total settlement amount, number of misconduct cases, and average settlement per case.

New York is the number 1 state that has paid the most in police misconduct settlements on a per-case basis, close to $73 million.

Followed by Illinois with an average payout of $20,337,059 per case. Pennsylvania places third with $14,798,000 per case.

California was the fourth highest, but had more misconduct settlements in total nationwide.

Florida fared much better than other states, ranking only 21st overall in the study, with an average settlement of $2,132,500 per case. That was a 64% decrease in comparison to the national average of $5,930,098. The state has processed two cases, which amounted to a total of $4,265,000.

Seth Bader, spokesperson at Bader Scott law firm said these statistics show the substantial financial impact of police misconduct cases across the country. The high settlement amounts in states like New York and Illinois reflect both the severity of the cases and the legal precedents established in these jurisdictions.

“States with higher settlement amounts may be responding to public pressure for accountability, while also facing unique circumstances with specific high-profile cases that significantly raise their averages,” said Bader.

Bader also says the data shows that these top ten states are from entirely different regions, suggesting that police misconduct is a nationwide problem and isn’t limited to one specific area of the country.

“These significant payouts could have been money spent on more training for officers to avoid these situations in the first place – hopefully this will serve as a reminder that these cases are avoidable, and should not be frequent occurrences,” Bader said.
