Vermont reports the lowest proportion, with personal injury cases representing just 2.82% of its civil caseload.
Injured in Florida, a personal injury law firm, analyzed data from U.S. District Courts, focusing on civil cases filed over a one-year period.
The study shows that where you live could have a different outcome compared to living in another state.
“Our findings are truly eye-opening,” said a spokesperson from Injured in Florida. “The fact that personal injury cases can range from over 78% of civil cases in one state to less than 3% in another highlights the wide variation in how different regions handle these cases.”
Florida leads with a staggering 61,589 personal injury cases out of 78,546 civil cases (78.41%). This rate, significantly above the national average, might be attributed to Florida’s thriving tourism industry and substantial retirement population, both of which could contribute to a higher incidence of accidents.
Florida’s urban communities vs rural areas also determine the higher percentages of personal injury cases, likely due to increased population density and traffic.
Other factors include legal frameworks, such as No-Fault insurance or specific tort reform measures, show varying rates of personal injury litigation.
The study showed Florida had longer wait times in civil courts due to the volume of personal injury cases, which could amount to higher insurance premiums to offset the increased likelihood of litigation.
