The ABLE Law: Helping Floridians With Disabilities

In July 2015, the State of Florida created Florida ABLE, Inc. (d/b/a ABLE United) a registered not-for-profit and direct support organization of the Florida Prepaid College Board to administer the ABLE United Program. Their goal is to encourage and assist individuals with disabilities in saving private funds to help cover costs that support their health, independence, and quality of life.

Now in 2025, Florida’s disability community will celebrate a major milestone on national ABLE Savings Day, August 14, as ABLE United—the state’s official ABLE program—announces that its 14,000 account holders have saved a combined total of over $130 million.

ABLE United accounts allow Floridians with a disability to save up to $19,000 per year while maintaining eligibility for public benefits, such as Supplemental Security Income and Medicaid. Family and friends can contribute to maximize savings, and funds saved in an ABLE account can be used for various expenses, such as assistive technology, education, housing, transportation, health care, and more. Enrollment is free, there are no monthly fees, and savings grow tax-free if withdrawals are made for Qualified Disability Expenses.

Until now, only people whose disabilities began before age 26 could open ABLE accounts. That changes Jan. 1, 2026, when eligibility expands to include individuals whose severe diagnosis or disability began before their 46th birthday—giving 6 million more Americans with disabilities, including over 1 million veterans, access to tax-free savings for both daily needs and future goals.

“Reaching $130 million in savings shows that Floridians are embracing ABLE accounts as a game-changing disability financial planning tool. Expanding this to include hundreds and thousands more individuals in Florida is a game changer,” said John Finch, Director of ABLE United. “With eligibility expanding to include people whose disabilities began before age 46, we expect to see these numbers grow as more individuals learn about the benefits of ABLE accounts.”

ABLE accounts became possible through federal legislation passed in 2014 and Florida’s subsequent adoption of the program. The Stephen Beck, Jr., Achieving a Better Life Experience (ABLE) Act, which passed federally in 2014, empowers individuals with disabilities and their families to save for future expenses. In July 2015, Florida created ABLE United, a registered not-for-profit and direct support organization of the Florida Prepaid College Board.

Florida is joining the 43 other states with ABLE programs in celebrating the second annual national ABLE Savings Day, which was created to raise awareness of this innovative savings opportunity. According to the National Association of State Treasurers, more than 214,000 Americans with disabilities have collectively saved $2.6 billion in ABLE accounts.
